UORadio.com (“UORadio,” “we,” “our,” or “us”) is owned and operated by UORealms LLC. UORadio is a service of UORealms LLC. By accessing or using UORadio, you agree to be bound by these Terms of Service. If you do not agree, you should discontinue use of the site and its services.
1. Service Description
UORadio provides online radio broadcasts featuring music, live DJ shows, gaming-related content, and community interactions. Content may include third-party music, commentary, and user-submitted material. Availability of the service is not guaranteed and may be interrupted or discontinued at any time.
2. Content Notice
UORadio broadcasts may contain strong language, music lyrics, or themes not suitable for all audiences. We are not responsible for the lyrical content of artists we play, the commentary of independent DJs, or the behavior of users participating in chat or shoutouts. Programming marked as “family friendly” will be indicated on our published schedule when applicable.
3. Age Requirement & Content Notice
UORadio is intended for listeners aged thirteen (13) and older. By accessing or using the site, you confirm that you meet this minimum age requirement.
Listeners under the age of eighteen (18) may use UORadio only with the knowledge and permission of a parent or legal guardian. Parents and guardians are encouraged to use their own discretion when allowing minors to access online audio content.
UORadio broadcasts may include strong language, mature themes, or song lyrics that are not suitable for all audiences. Listener discretion is advised.
4. User Responsibilities
By using UORadio, you agree not to engage in abusive, harassing, defamatory, or unlawful behavior. You are solely responsible for the content of your shoutouts, chat messages, and requests. Submissions may be broadcast publicly on-air or displayed on our site. UORadio reserves the right to remove, edit, or refuse any user-submitted content at its discretion.
5. Moderation and Enforcement
DJs, moderators, and representatives of UORealms LLC may moderate chat, shoutouts, and other user-submitted content. This may include warnings, deletion of content, or revoking a user’s access to interactive features. All moderation decisions are final.
6. Intellectual Property
All branding, site design, and original content created by UORadio or UORealms LLC are the property of UORealms LLC. Music and other broadcast content remain the intellectual property of their respective rights holders and are used in accordance with applicable licensing and fair use guidelines.
7. Disclaimer of Warranties
UORadio is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or complete accuracy of broadcast content. Use of the service is at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, UORealms LLC and its representatives shall not be liable for any damages, losses, or claims arising from the use of UORadio, including but not limited to issues related to broadcast content, user submissions, or service availability.
9. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to your use of UORadio shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration shall be administered by the American Arbitration Association (AAA) under its applicable rules. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The arbitrator shall have the authority to grant any relief available in a court of competent jurisdiction.
Each party shall bear its own attorneys’ fees and costs, except that the arbitrator may award fees and costs to the prevailing party where permitted by law. The cost of initiating arbitration, including filing fees, shall be borne by the party initiating the claim, subject to the applicable arbitration rules.
10. Severability
If any provision of these Terms of Service is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall continue in full force and effect. An unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the intent of the original provision.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions.
